Mediate Agreement

    AGREEMENT TO MEDIATE

    This Agreement is made between the below-named parties (“CLIENTS”) and Out-of-Court Solutions, Inc., an Arizona corporation (“OOCS”). CLIENTS acknowledge that they desire to settle all matters between them in a collaborative manner through mediation, and will: 1. Attend scheduled mediation sessions at mutually agreed upon times. Failure to provide OOCS at least 24-hours’ notice for an appointment cancellation will result in a one-hour charge. 2. Compensate OOCS at the rate of $295 per hour for time spent with CLIENTS during mediation and to study documents, correspond, make telephone calls, prepare memoranda and agreements, and do such other things as may be reasonably necessary to facilitate CLIENTS’ reaching agreement. 3. Uphold the confidentiality of the mediation process, agreeing that OOCS need not retain any notes or other records of the mediation and CLIENTS will not subpoena any records or representatives of OOCS in any pending or future legal action or proceeding. 4. By entering the names and date below, and submitting this Agreement to OOCS, CLIENTS acknowledge and confirm that they are jointly and severally obligated to pay OOCS’s fees and reimburse OOCS for any reasonable express mail or other out-of-pocket expense incurred on their behalf.
