Arizona’s New Spousal Maintenance Calculator: What You Need to Know

As of September 1, 2025, Arizona’s new spousal maintenance (alimony) calculator is in effect. Key changes include: mortgage payments are no longer considered, overtime income is averaged over three years if it was consistently earned during the marriage, retirement income is only counted once a spouse is old enough to access it, and the previous assumption of a 4% return on investments has been eliminated.

What you need to know is that the guideline amount or duration produced by the new spousal maintenance calculator is only one factor among several—along with whether the requesting spouse is “eligible” under Arizona Revised Statutes § 25-319(A), the actual or attributed income of each party, and the parties’ right to agree to deviate from the guidelines to whatever amount and duration they believe is fair and equitable.

That is why the mediators at Out of Court Solutions take the time to help clients understand that spousal maintenance should never be determined by the calculator alone. We guide clients through the broader factors the law requires—such as eligibility, actual income, and fairness—so they can make informed decisions that truly reflect their unique circumstances.
